The court hearing of the a lawsuit of the CN OPORA to the Head and members of special election commission #711092 (Cherkasy City Maternity Home "Center of Mother and Child" Communal Institution, located at the address 30 Rokiv Peremohy 16/1 st.), in electoral district #194, didn't allow official observer of the Civil Network OPORA NGO to be present during voting at the place of residence. On the election day, we reported a situation when one of the observers wasn't allow to enter wards even despite she had made a fluorography. Therefore, the observers didn't observe the voting process. Thus, the right of official observers to be present during the issuance of ballot papers, secured by the Article 78(9.1) of the Law of Ukraine on Elections of People's Deputies of Ukraine, was violated. Unlawful actions of the Head and commission members were reported in the protocol of electoral law violation as of 12/15/2013, in accordance to the Article 78 (9.6) of the Law of Ukraine on Elections of People's Deputies of Ukraine.
According to the Article 94 (15.2) of the Law of Ukraine on Elections of People's Deputies of Ukraine, the district election commission can declare the voting at a polling station void in case it's proved that official observers were unlawfully banned from entering the polling place.
