On 11 March, the Working Group on the Election Code has finished consideration of the document before the second round. The Code is ready for consideration in the authorized parliamentary committee.

The working group has also had its last meeting today, attended by MPs Ihor Popov, Ruslan Sydorovych, and Oleksandr Chernenko. The meeting was also attended by member of the working group and co-author of another version of the Code Viktor Zalizniuk, and assistants of MPs Olha Bohomolets, Dmytro Dobrodomov, Yurii Levchenko, Mykhailo Papiiev, Ihor Popov, Viktoria Ptashnyk, Valerii Pysarenko, and Ruslan Sydorovych. Today's meeting was dedicated to the summary of the work done.

Oleksandr Chernenko: “We made a great professional job, I am grateful to each of you. On the one hand, it's a shame that only a minority of the working group have been attending the meetings. On the other hand, the people involved showed they prepared well and were deep into the topic. We all received a priceless experience. Although we have considered each amendment, there is still some uncertainty about the certain issues. At this stage, all the amendments that were rejected, and no one suggested better solutions for them, will be considered as rejected. However, it doesn't mean they are rejected for good, it's only an opinion of the working group. They can be further discussed in the Committee and in the hall. We have also proposed our amendments based on many amendments that we had rejected and which corrections after the first reading were not satisfying. However, as long as we doesn't have an authority to submit amendments, we will suggest the Committee to submit them. Draft Election Code will require some technical improvements after the working group. However, it's not our responsibility, – the document will be further considered by the authorized Committee. No one can say for sure how it's going to happen: whether all amendments will be considered again, or only a part of them. Perhaps, the Committee will decide to formally accept the position of working group.”

Ruslan Sydorovych: “The working group doesn't substitute the Committee and editors. Thus, if there are some punctuation or other errors, they should be removed in the process of technical and legal correction. We don't know which decision the Committee is going to take, and when the document is going to be considered in the hall. The amendments that were adopted earlier can turn out to be “displaced” and disbalance the whole document. Therefore, before the final voting for the text of election code, the committee should analyze how the document transformed in the session hall, and check the amendments to be considered in the hall. In such a way we will understand what needs some correction to guarantee that the final document in well-balanced.”

Viktor Zalizniuk: “As long as another model of electoral system that became a basis for Valerii Pysarenko's version of election code was rejected in the first reading, I did my best to become useful for this working group. I believe we worked professionally, avoiding political motivation. At this stage, however, a political discussion will join the professional approach.”

Ihor Popov: “To smooth over the impact of political expediency, I suggest the following idea. As long as not all the participants of working group attended 100% of meetings, some factions have probably received the message correctly. The document is quite large, and not all factions are represented in the authorized committee. Perhaps, it would be good to suggest an open presentation or individual consultations. Factions should have a chance to understand whether the document is in line with their political programs, and make discussions in the committee and in the hall more professional than political.”

Olha Kotsiuruba: “I am grateful to the working group for being open to the public. Some propositions from the public were taken into consideration, some were ignored. However, there was a balance here, and amendments from each representative were fully taken into consideration. People say that the best decision is when everyone is a little bit unhappy. This is a nice description for this document, to my mind. Thank you for the time we shared, and hope that it will bring an adopted document.”

 

Thus, the working group held 43 meetings from 16 April 2018 to 11 March 2019. 98.8% of 4,296 amendments were considered on 35 meetings from April to December 2018. In 2019, meetings were dedicated to technical corrections and consideration of topics, which the working group haven't managed to agree upon in 2018. For example, realization of voting rights by internally displaced persons, migrant workers and people with disabilities.

It should be mentioned, that 251 amendments were considered by the group of Sub-committee on Elections and Referendums of the VRU Committee on Judicial Policy and Justice. The previous consideration of amendments in this group started on 21 December. On 28 February, VRU Committee on Judicial Policy and Justice had approved the working group to prepare draft Election Code of Ukraine for the second reading (#3112-1). On the second meeting, held on 4 April, the membership of this official working group was approved.

The working group includes 24 MPs and 2 experts, who co-authored other versions of the Code. This working group doesn't have a regulation for its activities and, therefore, there is no quorum or voting.

We would like to remind that on 7 November 2017, the Verkhovna Rada has adopted draft Election Code of Ukraine #3112-1 in the first reading. It was registered in the Parliament yet on 2 October 2015.
